Before the one-year period expires, you must either file another provisional application or submit a non-provisional application to maintain your patent pending status. A non-provisional application is a patent application that not only provides you with patent pending status but also enters the queue for examination by the USPTO.

Estimate following consultation. Claims are the legal definition of an application. They are required for a non provisional application, but can be included on a provisional application. Claims can only be added to a Full Service Patent Filing.

USPTO Provisional Filing Fee $60-$150

The filing fee is for a provisional application, and we will attempt to file your application at the reduced fee of $60. If we cannot do so, we will notify you before filing. Please note that provisional applications are not examined by the USPTO.

USPTO Non Provisional Filing Fee $364-$664

Filing fee is for a non provisional application. We will attempt to file your application at the reduced fee of $364. If we cannot file the application at the reduced fee, we will notify you before filing the application. Because non provisional applications are examined by the USPTO, non provisional application filing is only available with the Full Service Patent Filing and Add Claims selections.
